TERMS OF USE
Welcome to Minbar.
DEFINITIONS
The term “User/user” shall mean to include any person, who browses, visits, uses, accesses the Minbar.
The term “You” or “you” shall mean any person/entity, who visits, or browses, or explores, or accesses, or uses, or views, or registers on Minbar.
The terms “We” or “Us” or “Our” or “Company” shall mean to indicate MESOL INFORMATION TECHNOLOGY L.L.C, Minbar, and its affiliates as defined below.
MESOL or Minbar, shall mean to include Mesol as a whole, including Minbar platform and features, its employees, operators, staff, partners, directors, shareholders, representatives or any other group companies or persons associated with Mesol or Minbar. Reference to Minbar shall mean and include Mesol and vice versa.
Acceptance of these Terms
By accessing and using Minbar sites, services, and mobile applications—including any associated or generated applications and downloadable software (together “Minbar”)—you acknowledge that you are entering into a legally binding agreement with these Terms. This applies whether you are a guest or a registered user. We encourage you to read these Terms and the Minbar Privacy Policy thoroughly before using Minbar.
If you do not agree with these Terms or the Privacy Policy, you must refrain from accessing or using Minbar.
Changes to the Terms
Minbar is offered by MESOL INFORMATION TECHNOLOGY L.L.C (“Mesol”, “we” or “us”). We may revise and update these Terms from time to time at our sole discretion without any prior notice to you. Any changes are effective when we post them. Your continued use of Minbar following the posting of revised Terms means that you accept and irrevocably agree to the changes.
Where Minbar has provided you with a translation other than the English language version of the Terms of Use, then you agree that the translation is provided for your convenience only and that the English language version of the Terms of Use will govern your relationship with Minbar. If there is any contradiction between what the English language version of the Terms of Use says and what a translation says, then the English language version shall take precedence. The Privacy Policy of Minbar shall be read in conjunction with these Terms of Use.
Changes to Minbar
While we hope to always offer Minbar and all of its features, we reserve the right to change or cease offering Minbar or any part portion or functionality of Minbar without notice. We will not be liable if for any reason all or any part of Minbar is unavailable at any time.
Information About You and Your Access of Minbar
All information we collect on or through Minbar is subject to our Privacy Policy. By using Minbar, you consent to all actions taken by us in compliance with the Privacy Policy.
Permitted and Unpermitted Use
You may use Minbar in accordance with these Terms for either your personal and non-commercial use or for the internal use of your non-profit religious organization. All rights not expressly granted to you are reserved by Mesol. You agree to comply with below permitted and unpermitted terms of use of Minbar:
* Your use of Minbar is strictly for personal and non-commercial purposes. You agree to use Minbar for lawful activities and to refrain from using it in any fraudulent or illegal manner, or in any way that could harm Minbar’s reputation, goodwill, or cause financial damage to us or any third party.
* You agree to be strictly prohibited from directly or indirectly decompiling, reverse engineering, disassembling, modifying, copying, reproducing, distributing, transmitting, displaying, performing, publishing, licensing, creating derivative works from, transferring, selling, or removing any copyright, trademark registration, or other intellectual property rights or notices associated with Minbar, whether or not explicitly stated herein.
* You agree to not use Minbar to engage in or promote any activity which amounts to, misrepresentation, misleading, endangering of one’s life, harmful, coercive, threatening, deceptive, harassment, illegal, defamatory, abusive, obscenity, vulgarity, profanity, lewd, pornographic, tortious, libelous, infringement of other’s privacy, discriminatory, unethical, immoral, and/or for any money laundering or gambling purposes and for other such objectionable manner/purpose;
* You agree to refrain from posting, transmitting, promoting, or making available any content or material that contains viruses, Trojan horses, worms, spyware, time bombs, cancelbots, or any other harmful computer programs, routines, codes, or files and any content that has the potential to damage Minbar, infringe on the rights and interests of other users (registered or unregistered), or affect the functionality of any computer software, hardware, or telecommunications. Additionally, you will not engage in activities that may violate the data protection and privacy rights of Minbar, its users (registered or unregistered), or any third party.
* You agree to not promote or engage in any form of advertising, commercial solicitation, or business solicitation of any kind, nor require monetary investment from any individual using or accessing Minbar or conducting any such activities through Minbar.
* You agree to not use Minbar to impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
* You agree to not use, promote, or post any content on Minbar for the purpose of stalking, intimidating and/or harassing another and/or provoking others to commit any criminal offence or compel any User to share their personal details with you.
* You agree to not engage in pr promote any activity that amounts to infringement of the Intellectual Property Rights of Minbar, or of any third party, or any other user of Minbar whether registered or unregistered.
* You agree not to use pr promote deep links, page scraping, robots, spiders, or any other automated devices, programs, algorithms, or similar manual processes to increase traffic to Minbar, access, acquire, copy, or monitor any portions of Minbar, reproduce or attempt to reproduce, or circumvent the navigational structure or presentation of Minbar. Additionally, you agree to not obtain or attempt to obtain any content, documents, or information through any means not explicitly made available through Minbar.
* You agree to not attempt to gain access to Minbar in any manner not explicitly provided by Minbar. Furthermore, you agree to not promote or commit any action/omission which would disrupt or interfere with the security of Minbar, cause harm to it, or gain unauthorized access to user accounts, passwords, servers, or networks connected to or accessible through Minbar or any of its affiliated or linked sites.
* You agree to not promote or commit any action/omission which would hinder or interfere with any other person’s use or enjoyment of Minbar and its affiliated links/sites.
* You agree not to intentionally or unintentionally interfere with or disrupt the services and features provided by Minbar, nor to violate any applicable laws and regulations pertaining to your access to or use of Minbar.
* You agree to respect the privacy of all users and shall not attempt to obtain personal information about other users in an unauthorized manner. Harassment of any user to compel them to interact or communicate with you through Minbar is strictly prohibited.
* You agree to not attempt to alter, modify, or access any part of Minbar through unauthorized means, and you agree to utilize only the access methods provided by Minbar.
* You agree not to manipulate headers or identifiers in a manner that conceals the origin of any communications transmitted through the Minbar.
* You agree to comply with these Terms concerning your User Contributions
* You agree to use the Minbar solely for permitted purposes as outlined in these Terms and in accordance with applicable laws, regulations, and generally accepted practices in the relevant jurisdiction. In particular, you agree to not using the services in any manner that contravenes federal, state, local, or international laws applicable to your jurisdiction or any relevant jurisdiction related to Minbar.
* You shall not violate or attempt to violate any Terms outlined herein, to which you have consented to be legally bound by visiting, browsing, or registering for Minbar and its services/features.
* You shall not promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
You acknowledge that we reserve the right to hold you accountable for any breaches of Terms that may not be expressly stated here but are deemed illegal, unethical, immoral, or invasive of privacy. If you breach any of the Terms outlined herein, without prejudice to all our other rights and remedies, we reserve the right, without liability for compensation or refunds, to terminate your user account or block your access to Minbar at our discretion. However, you may contact us for further clarification regarding these matters. We may, at our sole discretion, restore your user account or access to Minbar.
You further acknowledge that, while we strive to maintain high standards for our services/features, there may be instances where you encounter content or information from third-party partners, links, or other service providers or users of Minbar that could be factually inaccurate, misleading, offensive if taken out of context, indecent to certain audiences, or otherwise objectionable. We shall not be held responsible for any claims related to such content.
User Contributions
Minbar may offer interactive features that allow users to post, submit, publish, display, or transmit content or materials (collectively referred to as “User Contributions”) to other users or third parties or on the Minbar Platform. However, we do not commit to reviewing User Contributions or any other materials prior to posting, and we cannot guarantee the immediate removal of objectionable content once published. Consequently, we accept no liability for any actions or omissions related to transmissions, communications, or content provided by any user or third party.
All User Contributions must comply with these Terms. By submitting any User Contribution through Minbar, you grant us, our service providers, and our respective licensees, successors, and assigns an irrevocable, worldwide, perpetual, royalty-free, non-exclusive license to use, copy, distribute, reproduce, modify, edit, adapt, publicly perform, publicly display (to the extent it is not protected by your privacy option if made available by Minbar at the time of making your User Contribution available on Minbar), and disclose such material to third parties for the operation of Minbar. This includes the right to sublicense these rights as necessary for the platform's functionality. We may share your User Contributions with affiliated organizations, companies, or individuals as described herein.
We reserve the right to remove any User Contributions at any time and for any reason, without prior notice. You agree to waive any rights of privacy, publicity, disclosure, or similar rights concerning all such uses as referred in this section, to the extent permitted by applicable law. Any actions taken pursuant to this section shall exempt us from all liabilities and responsibilities towards you. Furthermore, you acknowledge that we are not obligated to provide any compensation for the use of your User Contributions as outlined in these Terms.
You represent and warrant that you own or control all rights to your User Contributions and have the authority to grant this license. You also confirm that your User Contributions comply with these Terms. We are not responsible for the content or accuracy of any User Contributions posted by you or any other user of Minbar. For clarity, "User Contributions" excludes any content embodying Minbar’s Intellectual Property Rights, or any content provided by Minbar, which are protected under applicable Intellectual Property Laws.
User Contribution Information: While using the Minbar Platform and your Member Account, we and third parties (per their Privacy Policies, as applicable) may collect and store the following information:
User Interactions: Any questions, posts, or comments you make on the Minbar Platform on public forum or publicly visible, if such features are available.
Public Forum Contributions: Information shared on public forums available on the Minbar Platform.
Content submitted to Minbar, including surveys, quizzes, feedback, and other documents provided voluntarily or upon request, including any comments, posts, notes, communications, text, pictures, Member Account profile information of the user as per the features available (User Contributions). User Contributions (excluding to the extent kept private by customizing your Member Account) may be published and displayed in public areas of the Minbar Platform, associated websites, and social media accounts. Your contributions will be associated with your account as long as you do not delete them. Please be aware that disclosing personal information in public forums may allow others to collect and use that information. User Contributions are shared at your own risk, and we cannot guarantee that they will not be viewed or used by unauthorized parties. You acknowledge and agree to the risks inherent with respect to any of your information made available on the public forums of Minbar Platform and we will not be responsible for any consequences suffered thereof by you arising from the User Contributions made available publicly either by you or by us as per this section.
Representations and Warranties
By providing the above license, you represent and warrant that:
- You possess all necessary rights, licenses, and clearances to provide User Contributions and permit us to use and publish them as described.
- Your User Contributions are accurate and complete to the best of your knowledge.
- You are responsible for any third-party fees related to the provision, publication, and use of your User Contributions.
- The use or publication of your User Contributions does not infringe or misappropriate any third-party rights, nor does it constitute a fraudulent or misleading statement or misrepresentation.
- At the time of submitting any User Contribution on Minbar or your Member Account, you agree to comply with all applicable laws, including those governing your online conduct and acceptable content, as well as laws related to the transmission of any technical data exported from your country of residence.
Communication Methods
We may provide you with the ability to post notes, replies, participate in surveys, discussions, or communicate with us or third-party service providers. You agree to use the communication methods provided by us solely for sending communications and materials related to the subject matter for which these methods were made available. Your communications are governed by these Terms and our policies.
Acknowledgment of Communication Methods
By using the communication methods available on the Minbar and your Member Account, you acknowledge and agree that:
Communications sent to or received by third-party service providers or other third parties are not endorsed, sponsored, or approved by us in any manner;
You acknowledge and agree that the communication methods provided (including, but not limited to, chat room services) may be monitored or recorded for quality control purposes, and that any information or material shared as part of these services is provided under these Terms for informational purposes only.
Member Account Creation & Security
Minbar allows users to create an account (“Member Account”) by providing certain information to us. If you choose or are assigned a username, password, or similar credentials as part of our security procedures, you agree to treat this information as confidential. You must promptly notify us of any unauthorized access or use of your username or password, as well as any other security breaches. We reserve the right to disable any username, password, or other identifier, whether selected by you or assigned by us, at any time if we believe you have violated any provision of these Terms.
Creating a Member Account is necessary to access certain features of Minbar. To set up your account, you will need to provide personal information, including but not limited to your name, email address, and password, which will be collected and maintained in accordance with our Privacy Policies. During the account setup process, you may also be prompted to enter additional information, such as your date of birth and location, to help us tailor our services to your needs. Once your Member Account is successfully created, you may customize your profile page as permitted by Minbar. However, you must comply with any mandatory Member Account settings as instructed by Minbar to fully utilize your account. Failure to adhere to these requirements may result in restricted access to Minbar's features.
Upon successful creation of your Member Account, you will log in using your username and password, which will grant you access to all features and services available on Minbar. You agree not to share your Member Account details; any sharing is done at your own risk. You are responsible for ensuring that all information provided for your Member Account is accurate, current, and complete, and you will update it as necessary.
You are fully responsible for your Member Account and any activities that occur within it, including any harm or damage caused by its use, whether authorized or unauthorized. You must keep your login credentials confidential and protect them from disclosure. Sharing your account details is generally prohibited; however, if you do so, you will be liable for any consequences arising from this action, and Minbar will not be involved in disputes resulting from such disclosures. You shall indemnify Minbar against any claims arising from your failure to safeguard your account credentials.
If you suspect that someone else is using your account without permission, you must notify us immediately at contact@mesol.me. We will provide reasonable assistance to recover your account, for which your cooperation will be required.
Accessing and using our features on Minbar—whether through purchase, fees, or free access—does not grant you any ownership of the Intellectual Property Rights associated with those features, except as explicitly stated in these Terms. Your rights to use Minbar features are non-transferable, non-exclusive, and intended solely for your personal, non-commercial use, in accordance with these Terms and any applicable restrictions. All other uses are strictly prohibited. Specifically, you are prohibited from downloading, storing, reproducing, transmitting, recording, distributing, sublicensing, renting, sharing, modifying, adapting, editing, creating derivative works from, or otherwise transferring any content from Minbar without prior consent.
You must adhere to all copyright notices and restrictions on the Minbar and shall not remove any legal or proprietary notices.
Monitoring and Enforcement; Legal Compliance; Termination
You agree that we have the right to:
* take any action with respect to any user, Member account, or User Contribution that we deem necessary or appropriate in our sole discretion if we believe there to be a violation of these Terms, infringement of third-party rights, a threat to the personal safety of others, or a threat, liability, or harm to the goodwill associated with Minbar or Mesol;
* take appropriate action, including without limitation, referral to law enforcement and disclosure of your information, for any illegal or unauthorized use of Minbar; and/or
* terminate or suspend your access to all or part of Minbar for any or no reason, including without limitation, any violation of these Terms.
Without limiting the foregoing, we have the right to fully cooperate with any law enforcement authorities or court order requesting or directing us to disclose the identity or other information of anyone posting any materials on or through Minbar. YOU WAIVE AND HOLD HARMLESS MESOL AND ITS AFFILIATES, AND ITS LICENSEES AND SERVICE PROVIDERS AND ALL OF THEIR EMPLOYEES, OFFICERS, AND DIRECTORS FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY ANY OF THE FOREGOING PARTIES DURING OR AS A RESULT OF LEGAL INVESTIGATIONS AND FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER MESOL OR LAW ENFORCEMENT AUTHORITIES.
Your Reliance on Information
The information presented on or through Minbar is made available solely for general information purposes. Although we strive to provide information found on Minbar in various languages (if available only), translations to languages other than English of Minbar content are provided to us by other parties and we do not represent or warrant the accuracy of those translations. We do not warrant the accuracy, completeness, or usefulness of this information. Any reliance you place on such information is strictly at your own risk. We disclaim all liability and responsibility arising from any reliance placed on such materials by you or any other visitor to Minbar, or by anyone who may be informed of any of its contents.
Intellectual Property Rights
Minbar and its contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement of the same), are owned by MESOL, its licensors, or other providers of such material and are protected by United Arab Emirates and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Logos and Designs
The Minbar name and logo, Company/Mesol name and logo, and all related names, logos, product and service names, designs, and slogans are trademarks and/or copyright of MESOL. You must not use these marks and copyright without the prior written permission of MESOL. All other names, logos, product and service names, designs, and slogans on Minbar are the trademarks of their respective owners.
Copyright Infringement
If you believe that any User Contributions or other content provided on Minbar violates your copyright or other rights, please contact our designated agent by: (a) mail at Mesol Information Technology L.L.C, API World Tower, Ground Floor Office 323, Sheikh Zayed Road, Dubai P.O. Box 414494 (b) phone at +9714 528 0698 323; or (c) electronic mail at support@mesol.me. Please be aware that it is the policy of MESOL to terminate the Member Accounts of repeat infringers.
Third Party Links and Services
Minbar may include content or links to other sites or resources provided by third parties. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party websites linked to Minbar, you do so entirely at your own risk and subject to the terms and conditions of use for such websites. All statements and/or opinions expressed in these materials, and all articles and responses to questions and other content, other than the content provided by MESOL, are solely the opinions and the responsibility of the person or entity providing those materials. These materials do not necessarily reflect the opinion of MESOL. We are not responsible or liable to you or any third party for the content or accuracy of any materials provided by any third parties.
Geographic Restrictions
We make no claims that Minbar or any of its content is accessible or appropriate outside of the Jurisdiction it is made available by us. Access to Minbar may not be legal by certain persons or in certain countries. If you access Minbar from outside the permitted geographic jurisdictions, you do so on your own initiative and are responsible for compliance with local laws.
Disclaimer of Warranties
YOUR USE OF MINBAR, ITS CONTENT, AND ANY FUNCTIONALITY, SERVICES, OR ITEMS OBTAINED THROUGH MINBAR IS AT YOUR OWN RISK, ALL OF WHICH ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NEITHER MESOL NOR ANY PERSON ASSOCIATED WITH MESOL MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF MINBAR. WITHOUT LIMITING THE FOREGOING, NEITHER MESOL NOR ANYONE ASSOCIATED WITH MESOL REPRESENTS OR WARRANTS THAT MINBAR OR ANY FUNCTIONALITY CONTENT OR ANY SERVICES OR ITEMS OBTAINED THROUGH MINBAR WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT MINBAR OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT MINBAR OR ANY SERVICES OR ITEMS OBTAINED THROUGH MINBAR WILL OTHERWISE MEET YOUR NEEDS OR EXPECTATIONS.
MESOL HEREBY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
THE FOREGOING DOES NOT AFFECT ANY WARRANTIES WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Limitation on Liability
IN NO EVENT WILL MESOL, ITS LICENSORS, SERVICE PROVIDERS, OR ANY OF THEIR EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE MINBAR, ANY WEBSITES LINKED TO IT, ANY CONTENT OFFERED ON OR THROUGH MINBAR, OR SUCH OTHER WEBSITES OR ANY SERVICES OR ITEMS OBTAINED THROUGH MINBAR, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.
THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.
Indemnification
You agree to defend, indemnify, and hold harmless MESOL, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of Minbar including, but not limited to, your User Contributions, any use of Minbar content, services, and products other than as expressly authorized in these Terms or your use of any information obtained from Minbar
Governing Law and Jurisdiction
All matters, disputes, or claims relating to Minbar and these Terms (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of United Arab Emirates without giving effect to any choice or conflict of law provision or rule. Any legal suit, action or proceeding arising out of, or related to, these Terms or Minbar shall be instituted exclusively in the courts of UAE. By agreeing to these Terms and using Minbar, you waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
Reserved Rights of Mesol
We reserve the right to amend, modify, revise, or delete any part of Minbar, including its content and your Member Account, at any time, without liability to you, to the extent permitted by law.
Additionally, we may terminate your Member Account at any time, with or without notice, for any reasons we find appropriate. We also reserve the right to permanently close Minbar without any liability towards you.
We are not responsible for any temporary inaccessibility of Minbar and its features due to technical issues.
Furthermore, we may introduce fees or subscription models for accessing Minbar features and services at any time, without prior notice, and may suspend any features that are currently available for free.
All rights of Mesol not explicitly addressed herein are expressly reserved. These Terms do not prejudice any other rights or remedies available to Mesol, all of which are preserved. Any actions taken by Mesol in accordance with applicable laws, even if not specifically covered by these Terms, shall not constitute a breach of the user's rights. Consequently, Mesol shall be exempt from any liability arising from such actions.
OTHER MISCELLANEOUS TERMS
Severability: To the extent possible, each provision of these Terms shall be interpreted in such a manner as to be, effective and valid under Applicable Law. However, in the circumstances if any of the provisions under these Terms is held to be invalid or unenforceable with respect to certain aspects or circumstances, it shall nevertheless remain in full force and effect in all other aspects and circumstances. In the circumstance any of the provision of these Terms is deemed to be invalid and contrary to law by a final, binding judgement, then such provision shall be deemed severed from these Terms, but every other provision hereof shall remain in full force and effect. MESOL may with respect to such severed provision include any other substitute provision reflecting the original intent of MESOL as that of the severed provision and such substitute provision shall be deemed to be part of these Terms to the extent permissible under the Applicable Law.
Binding Agreement: Upon your visit to Minbar, it will be deemed that you have read these Terms and have consented to them by visiting and using our Website. You agree that these Terms and all other policies shall be binding on you from the moment you access, use and visit Minbar and any amendments to the Terms thereof shall also be deemed to be accepted by you on a prospective basis.
Relationship: Nothing contained in this Terms will be deemed or construed as creating a joint venture or partnership, employment, contractor or agency relationship between us and you. Neither you or nor us under these Terms and Policies, is authorized as an agent, employee, or legal representative of the other.
Assignment: You may not assign or transfer these Terms or the rights and licenses granted hereunder to any person, unless otherwise by our prior written consent. However, we may assign these Terms and the rights and licenses granted hereunder to any other person or company, without any restriction and without any need for your consent. Nothing in these Terms confers any right, benefit, or remedy on any third-party person or entity. You agree that your account is non-transferable and that all rights to your account and other rights under these Terms terminate upon your death. Any delay or failure by us to exercise any right we may have under these Terms does not constitute waiver by us of that right.
Entire Agreement: Except as explicitly stated otherwise, these Terms and our Policies constitute the sole and entire agreement between you and Mesol with respect to Minbar and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to Minbar.
Further Clarification: For clarity, by accessing, viewing, or registering with Minbar, or by agreeing to the User Consent Agreement, the user provides explicit and implied consent as required by law for Mesol to collect, store, use, and disclose Data or any other information in accordance with its Privacy Policy, without the need for additional consent, except as required by law or as implemented by Minbar on its platform, including confirms its obligation to be legally bound by these Terms.

By visiting, using, accessing, or registering on Minbar, you acknowledge and agree to provide your implied consent to be legally bound by these Terms.
You understand and agree that MESOL is not responsible or liable for any consequences suffered by you, including those arising from safety breaches, unlawful activities, or violations of these Terms. This includes, but is not limited to, any claims related to malfunctions, fraud, rights infringements, objectionable content, inaccurate data, or insecure links and websites provided by third parties or their users.
While MESOL strives to maintain the security and integrity of Minbar, it does not guarantee protection against such issues. To the extent possible, MESOL will take all necessary precautions to uphold safety standards and mitigate risks.
